Guardianships

Overview

Our attorneys first make sure you understand what a guardianship is, when it may be advisable, and alternatives that may be available. If warranted, we then proceed to establish a Guardianship for a minor child or a disabled or incapacitated adult of any age. Guardianship is used to step in legally to help with personal decisions or asset management or both. We can help with full or limited Guardianships, and in certain circumstances we can assist with establishing a guardianship on an emergency or temporary basis.

Guardianship of Minors

In certain circumstances, someone other than a parent of a minor child can become the court-appointed guardian of that child, sometimes with or without parental consent. If you are providing care for a minor child and wish to become their guardian, we would be happy to discuss your options with you and, if appropriate, pursue guardianship.

In other circumstances, a parent may wish or need to become appointed as guardian of their own child. If you have been told to become the court-appointed guardian of your own child, we are happy to help.

Guardianship of Disabled Adults

An adult with a disability is statutorily defined as a person who is not able to fully manage his or her person or estate, either because of mental deterioration, physical incapacity, mental illness, or developmental disability; or who, because of gambling or addiction wastes his or her estate so as to expose himself or herself to want or suffering; or who is diagnosed with fetal alcohol syndrome or fetal alcohol effects.
